Thank you for not smoking

Thank you for NOT smoking!!!

So you say you don't know why the house smells like smoke?  You say you don't smoke inside.  Why is there an ash tray on the counter?  Why does it smell like smoke?  Clearly you are smoking at the door with the door open... or in the garage...

What can I do as a landlord to prevent this?  What can I claim as damages?  What proof do I need?  How can I avoid this?

I've got my methods, but I'd love to hear your approach to handling smokers.

Smokers are not a protected class! Don't rent to them. I forget who it was, but they didn't rent to smokers or slobs, they scened them by walking out to their car with them. If their car smells like smoke or the interior is trashed they didn't rent to them! Just remember to treat everyone the same!

I have a smoker YES   NO box on my application and there is no smoking wording in my lease.

Brian,

We have a special stipulation in our lease that states:  No smoking in this home.  Smoking in the home will result in a complete loss of the tenants security deposit.   I've never had an issue with this!  We explain that to remove the smoke smell, we'd have to paint the whole house, re-carpet, + and that is NOT considered normal wear and tear.  

We also typically hold 1.5 to 2 months security deposit!

We will evict over smoking if discovered during one of our quarterly inspections/visits. It definitely takes vigilance. But you can usually smell smoke on their clothing during showings. Now...I like an occasional cigar, so I do have some minor level of sympathy for cigarette smokers. But not in our rentals or any we manage. I certainly would never smoke in my home either. And we clearly state expectation in lease and at lease signing.
